Colorado GOP asking US Supreme Court to overturn ruling disqualifying Trump from 2024 ballot

The Colorado Republican Party said it’s asking the U.S. Supreme Court to overturn a ruling that barred former President Donald Trump from appearing on the state’s 2024 ballot. 

Earlier this month, the Colorado Supreme Court, in a 4-3 vote, overturned a lower court ruling that allowed Trump to appear on the ballot as a presidential candidate. The initial ruling said a president is not among the officials subject to disqualification on a ballot. 

“By excluding President Trump from the ballot, the Colorado Supreme Court engaged in an unprecedented disregard for the First Amendment right of political parties to select the candidates of their choice and a usurpation of the rights of the people to choose their elected officials,” attorneys for the state Republican party wrote in a petition of the Dec. 19 ruling.

In their opinion, the justices on the state’s high court wrote that Trump “incited and encouraged” the use of violence to prevent the peaceful transfer of power on Jan. 6, 2021, when many of his followers stormed the U.S. Capitol as congressional lawmakers were certifying President Biden’s election win. 

The case is being appealed based on three main arguments: whether the president is among those officials subject to disqualification by Section Three of the 14th Amendment, the so-called insurrection clause; whether Section Three is “self-executing,” meaning that it allows states to remove candidates from a ballot in absence of any congressional action. 

The last point rests on whether denying a political party the ability to choose a candidate of its choice in a presidential primary and general election violates the First Amendment Right of Association. The attorneys said by excluding Trump, Colorado’s highest court has concluded that individuals, courts and election officials can possess legal authority to enforce Section Three. 

“Rejecting a long history of precedent, a state Supreme Court has now concluded that individual litigants, state courts, and secretaries of state in all 50 states plus the District of Columbia have authority to enforce Section Three of the Fourteenth Amendment,” the state party wrote.

The party also said that other states may follow Colorado’s lead and exclude Trump from their ballots as well. Disqualification lawsuits relating to Trump’s appearance on the ballot are pending in 13 states, including Texas, Nevada and Wisconsin.

“With the number of challenges to President Trump’s candidacy now pending in other states, ranging from lawsuits to administrative proceedings, there is a real risk the Colorado Supreme Court majority’s flawed and unprecedented analysis will be borrowed, and the resulting grave legal error repeated,” the petition states. 

In the lower court ruling, Colorado District Judge Sarah B. Wallace allowed Trump to stay on the ballot, but found that he “engaged in insurrection” for his role in the Jan. 6 Capitol riot.

Biden won Colorado by 13.5 points in 2020.

On Wednesday, the Michigan Supreme Court rejected an attempt to remove Trump from the state’s 2024 Republican primary ballot.

“Significantly, Colorado’s election laws differ from Michigan’s laws in a material way that is directly relevant to why the appellants in this case are not entitled to the relief they seek concerning the presidential primary election in Michigan,” Justice Elizabeth Welch wrote Wednesday, explaining the court’s ruling.

The dramatic title tilt helped popularize pro football at a time when it ranked behind baseball and college football — even boxing and horse racing — in the national sporting consciousness.

“The game captured the collective attention of the nation and as a result, pro football exploded across the country in the following years,” writes the Pro Football Hall of Fame. 

“By the mid-1960s, professional football became the nation’s favorite sport to watch and has remained on top ever since.”

The nationally televised spectacle was highlighted by two dramatic late scoring drives engineered by an unheralded 25-year-old Colts quarterback named Johnny Unitas. 

The sports thriller capped a long Christmas weekend for millions of Americans who were tuning into pro football for the first time. 

They witnessed the first overtime game in pro football history; one of the first NFL games broadcast nationally; and an incredible galaxy of football legends on the field and on the sidelines. 

Among them: New York Giants stars Frank Gifford, Sam Huff and Pat Summerall; and Colts icons Raymond Berry, Art Donovan and Lenny Moore.

A total of 17 future Hall of Famers participated in the game as players, coaches or executives.

The Giants coaching staff included assistants Tom Landry and Vince Lombardi. 

No star shined brighter than that of Unitas, who emerged from the game an American legend.

A sandlot gunslinger playing for $7 a week just three years earlier, he marched the Colts from their own 14-yard line in the final two minutes to set up a game-tying 20-yard field goal with seven seconds left to play in regulation. 

“It was one of the most dramatic two minutes in the history of any sport,” former NFL executive, broadcaster and football historian Upton Bell told Fox News Digital.

“People in those days knew you couldn’t put together a scoring drive in two minutes.”

Bell’s father, the late Bert Bell, was the NFL commissioner at the time. 

The senior Bell had convinced team owners just a few years earlier to adopt a “sudden death” format in the event of a tie in the league championship game. 

In “sudden death,” the first team to score wins. 

Without it, the 1958 NFL championship game would have ended in a 17-17 tie. 

“I don’t think a lot of people realized historically at the time what sudden death meant,” said Bell, who was in the stands for the game.

“Many players on the field didn’t understand. People around me were ready to go home, thinking the game ended as a tie.”

The Giants failed to score on the opening drive of overtime. 

Unitas then led the Colts 80 yards on 13 plays for the game-winning score.

An estimated 45 million Americans gathered around the television for the final minutes of unprecedented sports drama. 

They watched as Colts running back Alan “The Horse” Ameche crashed over the goal line from one yard out for the winning score. 

The massive viewership shattered all known television audiences for football that had come before. 

Mayhem ensued on the field, as a sense of witnessing history rushed over the 64,000 fans in attendance.

Unitas completed 26 of 40 passes for 349 yards — startling numbers in that era. His teammate Berry caught 12 passes for 178 yards. 

Berry’s 12 receptions stood as an NFL championship game/Super Bowl record for 55 years. 

The previously unknown sports term “sudden death” entered the American vernacular that day, said Bell. 

It’s still commonly used in all sports to describe a contest that ends on the next score by either team.

Commissioner Bell, a pro football pioneer, broke down and cried after the game, realizing he had witnessed a landmark moment for a league that often struggled to survive since its 1920 founding. 

The game benefited from low ambient lighting and the sharply different white jerseys of the Colts and dark blue jerseys of the Giants. 

It gave the game a stark, thrilling palette that popped on black-and-white television.

“Many of the viewers just beginning to tune in were not regular watchers of pro football and they were seeing something starkly different than the traditional college games played on sunny autumn afternoons,” author Mark Bowden wrote in his 2008 book, “The Best Game Ever: Giants vs. Colts, 1958, and the Birth of the Modern NFL.” 

He added, “This was more like mortal combat from some dark underworld. A master cinematographer could not have lit the scene more dramatically.” 

The massive interest in the game fueled the creation of the rival American Football League the following year. 

Eight AFL teams took the field for the first time in 1960. 

The two leagues merged in 1966 with the creation of the first AFL-NFL championship game, an event now known around the world as the Super Bowl. 

A behemoth of American sports culture, the Super Bowl was made possible by the drama of the 1958 NFL title game. 

A 2019 poll of dozens of football experts confirmed the status of the 1958 NFL championship contest as “the greatest game ever played.” 

The second greatest game on the list: the improbable 34-28 comeback win by Tom Brady and the New England Patriots over the Atlanta Falcons in Super Bowl LI.

It was the only other NFL championship game that went into overtime.

'Frasier' star Kelsey Grammer shares Christmas plans with his seven kids: 'It's my dream'

Kelsey Grammer is looking forward to celebrating the holidays with his seven children.

The 68-year-old actor, who recently starred in the Paramount+ revival of his iconic sitcom “Frasier,” shared his plans to spend Christmas at home with his family during an interview with Fox News Digital.

“We’re going to be in L.A. We always wrestle with – well, should we just travel? But then, honestly, home is home. And it’s nice to be home for Christmas and to celebrate and sit under the tree and have a fire and all the things we can still do,” Grammer said.

“It’s really lovely,” he continued. “We have a magnificent family. And it’s grown and grown throughout my years. You know, I’m up to seven kids and of all different ages. And it’s fantastic.”

“And if they can all be in the same room together and happy and smiling – nothing makes me happier. That’d be my Christmas present.”

“But, you know, we’ll see,” Grammer added with a laugh. “Some days that doesn’t work out so well. You know, because families are families. But that’s my dream.”

Grammer, who has been married four times, shares his eldest child, daughter Spencer Grammer, 40, with his first wife Doreen Alderman.

He is also father to daughter Greer Grammer, 31, whom he shares with his ex-girlfriend Barrie Buckner. 

The “Grand Isle” actor has daughter Mason Olivia, 22, and son Jude Gordon, 19, with his ex-wife Camille Grammer, 55. He married Kayte Walsh in 2011. Grammer and the U.K. native are parents to daughter Faith Evangeline, 11, and sons Kelsey Gabriel, 9, and Auden James, 7.

During his interview with Fox News Digital, Grammer also reflected on the importance of faith in his life, and how it has helped him overcome challenging times.

“That’s always been sort of a moving target,” the “Jesus Revolution” star explained. “What’s nice is I lost my faith for a long time. When I was younger. I got it back.”

He continued, “Because God doesn’t give up on you. Sometimes we close, and we just say, ‘I’m not listening. I’m not here for this.’ But then there He is. And that’s been my experience.” 

“And I’ve been given great many, many things by virtue of the fact that there were other things more important to me. And the most important thing was a sense of faith.”

Grammer also shared his thoughts on returning to the role of therapist Dr. Frasier Crane after almost 20 years.

The five-time Emmy Award winner originated the role during his stint on “Cheers” from 1984 to 1993 and starred in the hit sitcom’s spinoff series “Frasier” for 11 seasons from 1993 to 2004. He reprised the role in the Paramount+ “Frasier” revival, which aired its season finale earlier this month. 

“I wanted to prove to myself and to other people, of course, that Frasier was still interesting and still watchable and still funny,” Grammer told Fox News Digital. “Those were important parts of it. But also, I thought there were more stories to tell about this character because there’s more stories to tell in our own lives.”

Grammer recalled that the massive ratings success of the 2018 “Roseanne” reboot led him to think it was time to bring “Frasier” back.

“Frasier certainly is as interesting as the Roseanne character or any number of other shows,” he said. “And I thought, ‘We can find a way for this to happen.’ And we had a sort of ripe field to harvest as we always thought it would be a reflection of the relationship between me and my father, between me and my son. So that was always going to bookend things. And that was the foundational principle we talked to other writers about.”

For the 10-episode revival, Grammer teamed up with showrunners Joe Cristalli and Chris Harris. In an October interview with The Wrap, Cristalli revealed that he set up a parody Twitter feed about getting a job as a writer for the sitcom called “Frasier for Hire.”

Cristalli recalled that his agent sent the Twitter feed along with a “Frasier” spec script that he wrote to Grammer’s producers, who initially rejected his idea for the revival. Cristalli later collaborated on a new “Frasier” pitch with former “How I Met Your Mother” showrunner Harris. 

Cristalli told the outlet that Grammer and his producers chose their pitch after sifting through about 30 others. 

“They have a kind of silliness that I liked,” Grammer told Fox News Digital of Cristalli and Harris. “I was even drawn to it more because I thought – because in the past we had a kind of sense of how important we were and stuff. I thought, ‘You know, maybe we maybe don’t need to be so important. Maybe we just need to be kind of fun.’ And I think that… we’ve achieved that.

The actor said he also wanted to dispel the idea that viewers wouldn’t be interested in a “Frasier” revival or that fans wouldn’t embrace it due to their love for the original series.

“A lot of people think it’s an untouchable show,” he explained. “There’s a lot of sentiment from some of the past players. You know, it’s like, ‘Oh, it’s a jewel. It should be left alone. You can’t touch it.’ And I don’t think anything is that precious. I just don’t, because I mean, it’s like, ‘Come on.’ He’s a living, breathing character. He’s gone another 20 years. He might be interesting to catch up to. Let’s have a look into his life and see.”

Grammer continued, “And sure enough, he is kind of interesting and fun and still trying because he’s still trying. He’s in it with his whole heart. And that’s how he’s always been.

“I think the audience is always sort of behind the guy that sticks to it, you know?”

Though a second season of the “Frasier” revival has yet to be green-lit, Grammer said that he would be on board to return.

“We’re just kicking it around now,” he said. “I have an idea of what I’d like to do, but we’ll get into stories as soon as somebody says, ‘Please, let’s do some more.'”
